The Legal Necessities for a Civil Marriage to be recognised in Australia

The Notice of Intended Marriage. NOIM

This form must be completed in all details and received by me, your Marriage Celebrant at least one month and one day prior to the intended marriage date and no earlier than 18 months prior to the marriage date.

NOTE: It may not be possible for both the Bride and the Groom to sign the NOIM before it is lodged with me. So where either the Bride or the Groom is not available to sign, the available party to the marriage should complete the NOIM in as much detail as possible and get it to me within the prescribed time period of one month and one day either signed and witnessed or that can be done in front of me. The other party can sign at a later date so long as I have viewed ALL the documentation listed below. Please note that the second signature must be obtained before I can solemnise the Marriage.

The NOIM requires that I sight the following documents from BOTH the Bride and the Groom:

  • Proof of Identity by means of the original birth certificate (or birth extract) or, if either Bride or Groom were born outside Australia, by means of a valid NON Australian passport.
  • That you are both free to marry by virtue of never having been married, you are divorced or you are widowed. If either of you have been married before I need to sight the original Divorce Certificate or Death Certificate.
  • That you are both of legal age to marry, over 18 years old or have special permission to marry if either of you is over 16 years old but under 18 years old. Please ask me for more details if needed.
  • That there no legal impediments to your getting married. Possible impediments are listed in the Declaration that each party to a marriage must sign in my prescence.
